1. Acceptance of Terms

By creating an account with MyClass (“We,” “Us,” “Our”) and accessing any of Our tutoring services (“Services”), You (“Customer,” “You,” “Your”) acknowledge that You have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If You do not agree, You must cease use of Our Services immediately.

2. Definitions

“Tutor” refers to any individual engaged by MyClass to provide educational sessions. “Session” refers to the scheduled instruction time with a Tutor, whether online or in-person. “Guardian” refers to a parent or legal guardian responsible for any minor under 18 years of age who uses the Services.

3. Eligibility & Guardian Responsibility

MyClass services are intended for students of all ages; however, any user under 18 must have a Guardian create an account on their behalf or provide explicit consent. Tutors are not legal guardians or caretakers. A Guardian is strongly advised to be present during in-person or online tutoring sessions involving minors. If a Guardian is not present, You assume all risks and responsibilities for the minor’s safety and well-being.

4. Booking & Scheduling

Sessions may be scheduled through Our website or other designated platforms. By booking a Session, You consent to the date, time, and format (online or in-person) agreed upon. While Tutors strive to accommodate student preferences, changes in Tutor assignments are permitted only through MyClass, subject to availability.

5. Rebooking Policy

You may request to rebook a Session at least 24 hours before its scheduled start. If MyClass confirms the request, the date and time may be adjusted based on Tutor availability. You may also switch an in-person Session to online, if feasible. Neither the Session’s duration nor Tutor assignment can be changed via rebooking.

6. Cancellation Policy

You may cancel a Session at any time, but no refund or credit shall be granted. Providing a reason for cancellation is optional and does not obligate MyClass to offer any reimbursement. Once canceled, a Session may not be reinstated.

7. Tutor Qualifications & Working With Children Checks

All MyClass Tutors hold the requisite qualifications, subject-matter expertise, and valid Working With Children (WWC) checks (or equivalent clearance). We emphasize that, despite these credentials, Tutors are not authorized guardians or caretakers, and their role is strictly limited to providing educational guidance.

8. Fees & Payments

By scheduling a Session, You agree to pay all fees set out in MyClass listings, including applicable taxes or processing fees. MyClass reserves the right to modify its fee structure with prior notice to account holders. Late or failed payments may result in suspension or termination of Your account privileges.

9. No Guarantee of Academic Results

MyClass provides academically capable Tutors but makes no guarantees regarding a student’s performance, test outcomes, or academic results. The student’s effort and cooperation with the Tutor are essential components of progress.

10. Conduct & Usage

You agree to treat Tutors and MyClass staff courteously and comply with all relevant codes of conduct. MyClass reserves the right to discontinue services to any individual who engages in disruptive, abusive, or unlawful behavior. You also agree not to solicit Tutors for services outside of MyClass in a manner conflicting with any existing agreements between MyClass and its Tutors.

11. Location & Environment

For in-person Sessions, You are responsible for providing a safe, appropriate environment. MyClass disclaims liability for any injury or damage occurring at a location arranged by You. Guardians must ensure a secure setting for minors; choosing to proceed without a present Guardian is entirely at Your own risk.

12. Confidentiality & Privacy

MyClass handles personal data in accordance with Our Privacy Policy, available on Our website. MyClass and its Tutors shall treat any materials or information disclosed in Sessions as confidential. However, MyClass cannot guarantee the security of information transmitted electronically. Please read Our Privacy Policy to understand how We manage personal data.

13. Intellectual Property

All MyClass branding, educational content, and proprietary materials provided through the Services remain the exclusive property of MyClass. You are granted a limited, non-transferable license to use these materials for personal educational purposes only. Reproduction, distribution, or display of any MyClass content without express written permission is prohibited.

14. Limitation of Liability

To the fullest extent permissible under applicable law, MyClass will not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from or related to the use of Our Services. In all cases, MyClass’s total liability will not exceed the fees paid by You in the three (3) months preceding the event from which the claim arose.

15. Indemnification

You agree to defend, indemnify, and hold harmless MyClass, its officers, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising from Your breach of these Terms, Your misuse of the Services, or any negligent act or omission by You.

16. Tutor Not a Guardian

You explicitly acknowledge that Tutors serve only as academic instructors. Tutors are not responsible for supervision or guardianship of minors in Your household. By proceeding with Sessions in the Tutor’s presence or online, You agree that it is Your responsibility to ensure a Guardian’s availability if required or desired for the child’s safety and well-being.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Western Australia. Any dispute, controversy, or claim shall first be addressed through good-faith negotiation. If unresolved, parties agree to pursue mediation or arbitration prior to seeking legal remedy in the courts of Western Australia.

18. Suspension & Termination

MyClass reserves the right to suspend or terminate access to the Services at any time if We reasonably believe You have breached these Terms or pose a risk to other users or Tutors. Any outstanding obligations for fees or unsettled Sessions remain due following suspension or termination.

19. Modifications to Terms

MyClass may modify these Terms periodically. Notice of significant changes will be provided via email or an announcement on Our website. By continuing to use the Services after any updated Terms come into effect, You accept those changes.

20. Entire Agreement & Severability

These Terms, along with any policies referenced herein (including Our Privacy Policy), constitute the entire agreement between You and MyClass concerning the use of the Services, superseding all prior discussions. Should any provision be deemed invalid or unenforceable, the remaining provisions will continue in full force and effect.
